Terms of service

Last updated: October 16, 2026

OVERVIEW

Welcome to Woon! The terms “we”, “us” and “our” refer to Woon, an independent clothing brand operated by a sole trader established in Portugal.

Woon operates this online store and website, including all related information, content, features, tools, products and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms & Conditions (the “Terms”), together with the policies referenced herein, describe your rights and responsibilities when using our Services and purchasing our products.

Please read these Terms carefully, as they contain important information concerning orders, payments, delivery, consumer rights, intellectual property and limitations of liability.

By placing an order, you agree to these Terms. Your use of our website is also subject to the applicable provisions of these Terms and our Privacy Policy.

Our legal identity and business contact information are available in our Legal Notice.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services or placing an order, you represent that you have the legal capacity to enter into a binding agreement under the laws applicable to you.

To access certain features or purchase products, you may be asked to provide information such as your email address, billing details, payment information and shipping address.

You agree to provide accurate, current and complete information and to update it when necessary.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account, except where responsibility cannot lawfully be attributed to you.

You may not transfer or sell your account to another person without our permission.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to accurately represent our products, including their descriptions, colours, materials, measurements and appearance.

However, product colours and appearance may vary slightly depending on your device, screen settings and lighting conditions.

Product descriptions, availability and specifications may be updated when necessary. We reserve the right to discontinue products or limit quantities, subject to applicable law.

Nothing in this section limits your statutory rights concerning product conformity, quality or descriptions.

SECTION 3 – ORDERS

When you place an order, you submit an offer to purchase the selected products.

After completing checkout, you will receive an order acknowledgement confirming that we have received your order. This acknowledgement does not necessarily constitute acceptance.

A binding purchase contract is formed when we confirm dispatch of your order.

We reserve the right to decline or cancel an order for legitimate reasons, including product unavailability, payment issues, suspected fraud or obvious pricing errors, subject to applicable law.

If an order is declined or cancelled after payment has been collected, we will refund the relevant amount.

Please review your order carefully before submitting it. If you need to make changes or request cancellation, contact us as soon as possible.

Returns, exchanges, refunds and the statutory right of withdrawal are addressed in our Refund Policy, which forms an integral part of these Terms.

Nothing in these Terms or our policies limits your mandatory rights under applicable consumer protection laws.

Our products are intended primarily for personal use. Purchases intended for commercial resale require our prior authorisation.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price applicable to your purchase will be the price displayed at checkout when you place your order, subject to applicable law.

Prices are displayed in the currency indicated on our website.

For orders delivered within the European Union, displayed consumer prices include applicable VAT unless otherwise clearly indicated in accordance with the law.

For orders delivered outside the European Union, the applicable tax treatment may vary according to the destination and relevant regulations.

Shipping costs are calculated and displayed before the order is completed.

International shipments may be subject to customs duties, import taxes or clearance charges imposed by the destination country. Where these charges are not collected at checkout, they may be payable by the recipient, as explained in our Shipping Policy.

The total amount payable to Woon will be displayed before you confirm your purchase.

Promotional offers may be subject to additional conditions, which will be communicated where applicable.

You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use the payment method selected.

Payments are processed through the payment providers available at checkout, subject to their applicable terms and security procedures.

SECTION 5 – SHIPPING AND DELIVERY

We ship to the destinations made available at checkout.

Shipping methods, estimated delivery times, shipping costs and information concerning international deliveries are described in our Shipping Policy, which forms an integral part of these Terms.

Delivery times are estimates unless a specific delivery date has been expressly agreed. Delays may occur due to carriers, customs procedures or circumstances outside our reasonable control.

Such circumstances do not exclude our obligations or your rights under applicable consumer protection laws.

Risk of loss or damage to the products passes to you when you, or a third party designated by you other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.

Until that point, we remain responsible for the goods in accordance with applicable law.

For delivery questions or issues, please contact hello@woon.pt.

SECTION 6 – INTELLECTUAL PROPERTY

Our Services, including trademarks, brand names, text, photographs, graphics, product descriptions, videos, designs, website layouts and other original materials, are owned by Woon or their respective rights holders and are protected by applicable intellectual property laws.

These Terms permit you to access and use our Services for lawful personal and non-commercial purposes.

You may not reproduce, distribute, modify, publicly display, commercially exploit or otherwise use protected content without the necessary authorisation, except where permitted by law.

Nothing in these Terms grants you ownership or a licence to any intellectual property belonging to Woon, Shopify or third parties, except as expressly stated.

All rights not expressly granted are reserved by their respective owners.

SECTION 7 – OPTIONAL TOOLS

Our Services may provide access to optional tools or features offered by third-party providers.

These tools may be subject to separate terms, conditions and privacy policies established by their providers.

Where such tools are operated independently by third parties, we do not control their functionality, availability or content.

To the extent permitted by applicable law, we are not responsible for issues arising solely from independent third-party tools outside our control.

Nothing in this section excludes liability for our own obligations or responsibilities that cannot legally be excluded.

We may introduce new tools, features or services in the future. Their use may be subject to additional terms communicated where applicable.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to websites, content or services operated by third parties.

These websites are independently operated and may have their own terms and privacy policies.

We do not control or endorse all third-party content and are not responsible for its accuracy, availability or independent practices.

If you choose to access a third-party website, we encourage you to review its applicable terms and policies.

Nothing in this section affects our responsibility for purchases made directly from Woon or any liability that cannot lawfully be excluded.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Woon is powered by Shopify, which provides the technological infrastructure supporting our online store.

All purchases made through our store are contracts between you and Woon, not Shopify.

Shopify is not the seller of our products and does not independently assume Woon's contractual obligations concerning product quality, delivery, returns, refunds or statutory consumer rights.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims arising solely from the sale of products by Woon.

Nothing in this section limits rights or remedies that cannot lawfully be excluded.

SECTION 10 – PRIVACY POLICY

Personal information collected through our Services is processed in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify processes certain personal information to provide and support the Services. Information may also be processed by other service providers, including providers located outside your country of residence.

Our Privacy Policy explains how personal information is collected, used, shared and protected, together with applicable privacy rights and information concerning international data transfers.

For further information about Shopify's own processing activities, please consult the Shopify Privacy Policy.

SECTION 11 – FEEDBACK

If you submit reviews, ratings, suggestions, comments, photographs or other content relating to our products or Services (“Feedback”), you confirm that you have the necessary rights to submit that content.

You grant Woon a non-exclusive, worldwide, royalty-free, sublicensable licence to reproduce, display, distribute, adapt and use your Feedback in connection with our products, Services and marketing activities, subject to applicable law and your privacy rights.

This licence does not transfer ownership of your original content to Woon.

You agree not to submit Feedback that is unlawful, misleading, defamatory, abusive, infringing or otherwise violates the rights of third parties.

We may moderate, edit or remove Feedback where reasonably necessary to comply with applicable law, protect our Services or enforce these Terms.

Where reviews are incentivised or otherwise subject to disclosure requirements, the relevant information must be disclosed in accordance with applicable law.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, our Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, availability, shipping charges or delivery estimates.

We reserve the right to correct such errors and update information where necessary.

Where legally permitted, we may decline or cancel orders affected by material inaccuracies, including obvious pricing errors.

If an affected order is cancelled after payment has been collected, we will refund the relevant amount.

Nothing in this section limits your statutory consumer rights or allows us to unilaterally alter an accepted contract contrary to applicable law.

SECTION 13 – PROHIBITED USES

You may access and use our Services only for lawful purposes.

You agree not to use the Services to:

  • Violate applicable laws, regulations or third-party rights.

  • Infringe intellectual property rights belonging to Woon or others.

  • Submit fraudulent, misleading, abusive or unlawful content.

  • Harass, threaten, defame or impersonate another person.

  • Transmit malware, viruses or other harmful code.

  • Attempt to gain unauthorised access to our systems or accounts.

  • Interfere with the security, integrity or operation of our Services.

  • Collect personal information unlawfully.

  • Send unsolicited commercial communications or engage in phishing or similar activities.

  • Reproduce, scrape or commercially exploit substantial parts of our Services without authorisation, except where permitted by law.

We reserve the right to investigate suspected misuse and take proportionate action, including restricting access or reporting unlawful activity to the relevant authorities.

SECTION 14 – TERMINATION

We may suspend or terminate access to an account or certain Services where reasonably necessary due to a material breach of these Terms, unlawful activity, security concerns or other legitimate grounds.

Where appropriate and legally required, we will provide notice and an opportunity to remedy the issue.

Termination of website access does not automatically cancel existing purchase contracts or remove rights and obligations arising from orders already accepted.

Provisions that by their nature should survive termination, including intellectual property, liability, indemnification, dispute resolution and applicable payment obligations, will remain effective to the extent permitted by law.

SECTION 15 – DISCLAIMER OF WARRANTIES

We make reasonable efforts to ensure that our website and Services operate reliably and that the information provided is accurate.

However, we do not guarantee that access to our website will always be uninterrupted, error-free or free from temporary technical issues.

To the extent permitted by applicable law, general website content and optional digital features are provided without additional warranties beyond those expressly stated or required by law.

Products purchased from Woon remain subject to all applicable statutory guarantees of conformity and mandatory consumer protections.

Nothing in these Terms excludes or restricts your legal rights relating to defective, damaged, incorrectly described or non-conforming products.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Woon and its service providers shall not be liable for indirect, incidental, special or consequential losses arising solely from the use of our Services where such liability may lawfully be excluded.

We are not responsible for losses caused exclusively by circumstances outside our reasonable control, provided that this does not affect our contractual or statutory obligations.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury where liability cannot legally be excluded, breaches of mandatory consumer protection law, or any other liability that cannot lawfully be restricted.

In particular, nothing in this section limits your statutory rights concerning product conformity, delivery, refunds, withdrawal or other mandatory consumer remedies.

Any limitation of liability applies only to the extent permitted by the laws applicable to the relevant transaction.

SECTION 17 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify Woon against reasonable and demonstrable losses, damages or third-party claims directly resulting from your unlawful use of our Services, intentional misconduct or infringement of third-party rights.

This obligation applies only where the relevant loss is legally attributable to your conduct.

It does not apply to ordinary consumer purchases made in accordance with these Terms or to losses arising from Woon's own acts, omissions or legal obligations.

Nothing in this section restricts your mandatory consumer rights or requires you to assume liability that cannot lawfully be imposed.

SECTION 18 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be limited or excluded to the extent necessary under applicable law.

The remaining provisions will continue in effect insofar as they can operate independently and their continued application is legally permissible.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies expressly incorporated by reference and the information agreed at checkout, constitute the contractual framework governing purchases made through our store.

Nothing in this section excludes mandatory pre-contractual information, statutory consumer rights or other legally binding obligations.

Any ambiguity will be interpreted in accordance with applicable law, including relevant consumer protection rules.

SECTION 20 – ASSIGNMENT

You may not transfer your contractual rights or obligations to another person without our consent, except where such transfer is permitted by applicable law.

We may transfer our rights or obligations where legally permitted, provided that doing so does not reduce your contractual protections, statutory consumer rights or available remedies.

Where notice or consent is required by law, we will comply with those requirements.

SECTION 21 – GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of Portugal.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections applicable under the relevant rules of private international law.

Any dispute will be submitted to the courts having jurisdiction under applicable law.

Nothing in these Terms requires a consumer to bring proceedings exclusively before the courts of Braga, Portugal, where mandatory jurisdiction rules provide otherwise.

For questions, complaints or disputes, please contact us at hello@woon.pt. We will make reasonable efforts to resolve matters directly.

Information concerning applicable alternative dispute resolution mechanisms is available in our Legal Notice or otherwise provided where required by law.

SECTION 22 – HEADINGS

The headings used in these Terms are included for convenience and do not affect the interpretation or enforceability of their provisions.

SECTION 23 – CHANGES TO TERMS OF SERVICE

You can review the most current version of these Terms at any time on this page.

We may update, modify or replace these Terms to reflect changes in our Services, business operations or applicable legal requirements.

Updated Terms will be published on our website, together with the latest revision date.

Where required by law, we will provide appropriate notice of material changes.

Changes will not retroactively alter the terms of an already concluded purchase contract unless permitted by law or expressly agreed with the customer.

Your continued use of the website after an update may be subject to the revised Terms, but this does not override mandatory legal requirements concerning consent or contractual amendments.
